- What does 'filthy' mean? Oh, so I can sell Penthouse at any bookstore, or
- the Joy of Sex, or even an encyclopedia with a picture of a human body,
- or even the book "Where Did I Come From" but once I put it on the
- internet, I am a criminal that deserves up to five years in prison for
- downloading something that I could buy penalty free at the bookstore or
- check out from my public library.

- That sentence leaves just about anything open for censorship, doesn't it?

- There's that word "filthy" again. Interesting legal term, isn't it?
- What's filthy to you? What's filthy to me? Hmmm... I don't find "Venus"
- filthy, yet there are many communities that have called it such. Under
- this law, I'm subject to their standards when I post on the internet.

- Wow. Talk about leaving it open to interpretation. And tell me, just WHO
- decides what is "immoral?" Certainly the accused doesn't get to say that
- (s)he doesn't find sex immoral, so who does? Ah, the community that was
- offended. Just think of the fun we'd have if we could get the Quakers to
- just accept ONE computer. Think of the possibilities: the whole nation
- having to abide by the standards of every bible-belt town out there with
- a usenet account...
-
- One community in New England I saw on a documentary finds it morally
- offensive for men and women to eat together because women are servants
- and intended to eat the scraps "unseen"
-
- Maybe this will happen, maybe it won't, but under the CDA it's possible
- to enforce anywhere anytime. Maybe this legislation won't look at it in
- such a broad manner, but the next may be even worse. With this law,
- anything goes. IT IS COMPLETELY OPEN TO SUBJECTIVE INTERPRETATION.

- Here's that abortion part... (For those completely not paying attention)
-
- : Section 507 of the telecom bill amends Section 1462 of Title 18 of the U.S. Code
- : (Chapter 71) in ways which may make sending the following over the Internet
- : illegal: - any text, graphic, or sound that is lewd, lascivious, or filthy - any

- Now define those terms.
-
- The MODS on Aminet will have to all be deleted to be safe - the penalties
- for an organization making these things available are much worse. Each
- will have to now be checked carefully for any women making a sound that
- could possibly be construed as sexual.
-
- : differ in their interpretation of the amended Section 1462. Pat Schroeder's office
- : says that the changes "will criminalize a wide array of public health information

- : (Schroeder plans to bring a motion to the floor to remove the abortion language
-
- Schroeder is a spineless wimp for allowing the rest of the CDA to go
- unchallenged.
-
- : from the telecom bill on February 26.) Sam Stratman from Rep. Hyde's office
- : insists that courts have already invalidated subsection (c) of Section 1462
- : (although it remains on the books), so the extension of 1462 to include
- ^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^
- Interesting...
-
- : Technically, the telecom bill does criminalize abortion discussion. However, it
- : is unlikely that any U.S. court would enforce the amended Section 1462, as it is
- : legally toothless (though it has not yet explicitly been ruled unconstitutional).
-
- Willing to bet your freedom on it? The cost of the court battle alone is
- enough to ruin your life, even if you don't get "punished" for it.
-
- If I have a score to settle with someone who talks about abortion, I
- merely need to start collecting all their public posts and send any that
- discuss abortion to the authorities at which point their life is as good
- as gone.
